Statement by Nadia Murad and Amal Clooney on First ISIS Conviction for Genocide

Frankfurt, November 30, 2021

Today, a German court convicted Taha Al-J., an Islamic State member, of genocide, crimes against humanity and war crimes following his enslavement and abuse of a Yazidi woman and her 5-year-old daughter, which resulted in the child’s death. The Iraqi national was sentenced to life imprisonment. This is the first trial, and the first conviction, of an ISIS member for genocide anywhere in the world.

According to Nadia Murad:

“This verdict is a win for survivors of genocide, survivors of sexual violence, and the entire Yazidi community. Thank you to Germany for today's historic conviction. Germany is not only raising awareness about the need for justice but is acting on it. Their use of universal jurisdiction in this case can and should be replicated by governments around the world.”

Nadia Murad added:

“When survivors seek justice, they look for someone to give them hope that justice is possible. Amal gave me and many survivors hope that we will achieve justice. I am grateful to Amal for her tireless work to bring ISIS members to court.”

Counsel Amal Clooney, who represents Yazidi genocide survivors in several proceedings, including the co-plaintiff in the case against Taha Al.-J., added:

“This is the moment Yazidis have been waiting for. To finally hear a judge, after 7 years, declare that what they suffered was genocide. To watch a man face justice for killing a Yazidi girl – because she was Yazidi. There is no more denying it – ISIS is guilty of genocide. I am in awe of my client’s courage and grateful to Germany for defending the principle of universal jurisdiction which means that crimes like this must be prosecuted wherever and whenever they occur.”

Justice is vital not only to helping survivors heal, but to preventing future genocides. Germany prosecuted this defendant using the legal principle of ‘universal jurisdiction,’ which allows national prosecutors to try war criminals for atrocities they committed abroad. In the case of Germany, this applies even if neither the victim nor the defendant is German. We call on all nations to follow this example and assist in the prosecution of ISIS militants who perpetrated crimes against humanity and genocide of the Yazidi people.

BACKGROUND: Beginning in 2014, the Islamic State’s terror campaign targeted the Yazidi community, an ethno-religious minority within Iraq. This campaign, which included mass murder, sexual violence, enslavement, and other atrocities, was deemed a genocide by the United Nations following a comprehensive investigation into ISIS’ crimes. However, no individual militant has been tried or convicted on charges of genocide – until now.

أدانت محكمة ألمانية اليوم طه الجميلي ، عضو في تنظيم الدولة الإسلامية، بارتكاب إبادة جماعية وجرائم ضد الإنسانية وجرائم حرب بعد استعبادِه وإساءته معاملة امرأة إيزيدية وابنتها البالغة من العمر 5 سنوات، مما أدى إلى وفاة الطفلة. . وحُكم على المواطن العراقي بالسجن المؤبد. تُعتبرُ هذه أول مُحاكمة وأول إدانة لعضو في داعش بتهمة الإبادة الجماعية في أيّ مكان في العالم

هذا الحكم هو انتصارٌ للناجين من الإبادة الجماعية، والناجين من العنف الجنسي، والمجتمع الايزيدي بأكمله. شكراً لألمانيا على قيامِها بهذه الادانة التاريخية. لا تكتفي ألمانيا بنشر الوعي حول الحاجة إلى تحقيق العدالة فقط، بل تعمل على تطبيقِها. استخدامهم للمحاكمة القضائية العالمية في هذه الحالة يُمكن وينبغي أن تكررهُ الحكومات في جميع أنحاء العالم

وأضافتْ المحامية أمل كلوني، التي تمثلُ الناجين من الإبادة الجماعية الأيزيديين في عدة إجراءات محكمية، بما في ذلك المدعي المشارك في القضية المرفوعة ضد طه الجميلي
